Generally speaking, defective products fall into three categories:
- Manufacturing defects. In these cases the injury was caused as a result of defect in the manufacturing process of the product. One example you may have heard about involves Firestone tires. Due to a defect in the manufacturing process, the tread on the tires had a tendency to separate from the tire with often devastating consequences.
- Design defects. In these cases the injury was caused by a defective design. A common example is SUVs which have too high of a center of gravity and a wheel base that is too narrow. These SUVs, as a result of the design process, are extremely unsafe when emergency steering maneuvers must be used. Medical devices, including pace makers, have also been found to have design defects causing serious injuries.
- Failure to warn or “inadequate warnings.” Failure to warn cases refer to injuries caused as a result of a product sold without a proper warning to the consumer. Perhaps the most well known “failure to warn” cases involved the tobacco companies. Essentially the tobacco cases were based on a failure by the tobacco companies to adequately warn the public about the addictive and dangerous nature of its products. In fact, the tobacco companies not only failed to warn the public about dangers well known to the industry, many tobacco companies claimed their products were not addictive or dangerous.
